How long does it take to get divorced in the UK?

The divorce process in England and Wales typically takes 4-6 months from filing the application to receiving the final order. However, this timeframe can vary depending on factors such as court backlogs and the complexity of financial settlements or child arrangements.

Do I need grounds for divorce in the UK?

As of April 6, 2022, the UK introduced "no-fault" divorce. You no longer need to provide specific grounds for divorce. Instead, you can simply state that the marriage has irretrievably broken down, without assigning blame to either party.

How is property divided in a UK divorce?

The court aims for a fair distribution based on factors including the length of the marriage, the needs of any children, each party's income and earning capacity, and contributions to the marriage. The starting point is often a 50/50 split, but this can vary depending on circumstances.

Can I prevent my ex-partner from moving away with our children?

If you have parental responsibility, your ex-partner cannot legally move away with your children without your consent or a court order. If you can't reach an agreement, you can apply to the court for a Prohibited Steps Order to prevent the move or a Specific Issue Order to determine whether the move should be allowed.

Is mediation compulsory before going to court for family disputes?

Attending a Mediation Information and Assessment Meeting This requirement can be waived in specific circumstances, such as cases involving domestic abuse or where there are child protection concerns.
